Public Offer Agreement
PUBLIC AGREEMENT (OFFER)AS OF 07.05.2022
LIMITED LIABILITY COMPANY "MEDICAL CENTER "SHKIRYAK CLINIC" (License of the Ministry of Health of Ukraine order dated 26.05.2021 No. 1038, Registration dossier dated 28.04.2021 No. 1796/21/N), hereinafter "Contractor", and an individual who orders medical services on a paid basis, hereinafter "Patient" and/or "Customer", hereinafter collectively referred to as "Parties", and each separately — "Party", have concluded this Public Agreement on the provision of medical services (hereinafter — "Agreement") as follows:TERMINOLOGY:- Patient — an individual who directly receives medical services from the Contractor.
- Customer — an individual with full legal capacity who has ordered medical services or services on their own behalf or on behalf of the Patient. When ordering medical services on behalf of the Patient, the Customer confirms that they act in the Patient's interests and have received voluntary consent from the Patient. If the Patient is a person with partial or limited legal capacity, the ordering of Services may only be carried out by the Customer.
- Medical service — a specific action or set of actions performed by the Contractor's medical personnel for the purpose of diagnosis, treatment, prevention or rehabilitation of diseases, pathologies or other pathological conditions of the Patient.
- Service — a specific action or set of actions performed by the Contractor's medical and non-medical personnel for the purpose of informational service to the Customer. The scope of informational service is determined by the relevant terms of service.
- Terms of service — a document that establishes the procedure and conditions for receiving relevant services provided by the Contractor. The terms of service are published on the Contractor's website.
- Acceptance — an action indicating the voluntary consent of the Patient and/or Customer to this Agreement, its annexes and/or terms of service. Acceptance is considered registration of a medical service order on the website and payment through the website. The beginning of actual provision of medical services or services: giving consent to the processing of personal data.
- Order — a request placed by the Patient or Customer on the Contractor's website, which specifies the list of medical services or services that the Patient will receive from the Contractor during a visit to the Contractor or in another way.
- Contractor's Website — shkiryak.com.ua.
- Price list — a directory of medical services or services and their prices.
- 1.1. This agreement is a public offer in accordance with the current legislation of Ukraine, to which the provisions of Articles 633, 634, 641 of the Civil Code of Ukraine apply. The terms of this Agreement are uniform and binding for all Patients and/or Customers who have applied to the Contractor for medical services or services. The Patient and/or Customer cannot offer their own terms or proposals to this Agreement.
- 1.2. The list of medical services or services, their composition, duration and cost are determined by the annexes to this Agreement and/or the terms of providing such services, as well as in accordance with the current Price List, which is located at the Contractor's administrators and/or posted on the Contractor's website.
- 1.3. Medical services are provided in accordance with clinical protocols and medical care standards (medical standards) approved in the established manner.
- 1.4. Medical services are provided at the place(s) of the Contractor's medical practice; other services in accordance with the terms of providing such services.
- 1.5. The terms of this Agreement in general establish and regulate the mutual rights and obligations between the Contractor and the Patient and/or Customer when providing medical services or services, under the terms defined by the Agreement, its annexes and/or the terms of providing such services.
- 1.6. The Patient and/or Customer give consent to the Contractor to send information constituting medical confidentiality to the phone number, email address and/or postal address (hereinafter — contact details) specified by the Patient and/or Customer. The Contractor is not responsible for any risks associated with sending information and not receiving information using the contact details specified by the Patient and/or Customer.
- 1.7. This Agreement is posted on the Contractor's website and/or in a place accessible to the Patient and/or Customer at the place(s) of the Contractor's medical practice.
- 1.8. In case of concluding a private law (individual) agreement for the provision of medical services between the Patient and/or Customer and the Contractor, the terms of the private law agreement prevail.
- 2.1. Under this Agreement, the Contractor undertakes, at the order of the Patient and/or Customer, to provide medical services or services of proper quality, in accordance with the Contractor's price list, within the established terms and procedures defined by this Agreement, its annexes, terms of providing such services, other internal standards, instructions and regulations of the Contractor, and the Patient, in turn, undertakes to pay for and accept the services in accordance with the terms of this Agreement, its annexes and/or the terms of providing services.
- 2.2. By signing an application for personal data processing and/or performing other confirming actions, the Customer unconditionally and irrevocably accedes to the terms of this Agreement or its part that regulates the procedure for providing the ordered service.
